Terms of Service

These terms are an agreement between you and Creative Strategies, Inc. (“Creative Strategies”, “we”, “us”) governing your use of Creative Strategies Atlas at portal.thediligencestack.com and api.thediligencestack.com, The Diligence Stack subscriber research newsletter, the CS Atlas iOS app, and our integrations for third-party AI assistants (together, the “Service”). By accessing the Service you agree to these terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” includes it.
The Service
Creative Strategies provides source-linked AI economy research to paying subscribers through CS Atlas and The Diligence Stack newsletter: research studies, financial models, diligence dashboards, published notes, and a research agent that answers questions from our ingested research corpus with citations.
Accounts and eligibility
- Access requires an active paid subscription purchased through Substack, or access we grant directly.
- Your seat is personal. Do not share sign-in codes, magic links, passkeys, or sessions, and do not let others use the Service through your account.
- You are responsible for activity under your account. Tell us promptly at max@creativestrategies.com if you suspect unauthorized use.
Subscriptions and billing
Subscriptions are sold, billed, and managed by Substack under our Substack publication and Substack’s own terms, including cancellation and any refunds. Portal access follows your subscription: when it ends or lapses, access to the Service ends with it.
License and acceptable use
While your subscription is active, we grant you a limited, non-exclusive, non-transferable license to access the Service and use its research content for your own professional and internal business purposes. You agree not to:
- republish, redistribute, resell, or publicly post research content, models, or agent outputs, in whole or substantial part;
- scrape, bulk-export, or systematically download content, or access the Service by any automated means other than the integrations we provide;
- use the Service or its content to train or improve a machine learning model;
- circumvent authentication, entitlements, or usage limits, probe or disrupt the Service, or attempt to access other members’ data;
- use the Service in violation of applicable law.
Brief quotations with attribution to Creative Strategies or The Diligence Stack are welcome where fair use permits.
Research content — no investment advice
The Service provides research and analysis for informational purposes only. Nothing in the Service is investment, legal, tax, or accounting advice; a recommendation, offer, or solicitation to buy or sell any security or other instrument; or a substitute for your own judgment and diligence. Creative Strategies is not a registered investment adviser or broker-dealer, and no fiduciary or adviser-client relationship is created by your use of the Service. Content reflects sources and estimates as of its stated dates and may change without notice.
AI-generated output
Research agent responses are generated by AI from our research corpus. They may be incomplete or contain errors, and a cited source always takes precedence over the agent’s summary of it. Verify outputs against the linked sources before relying on them.
Third-party services
Parts of the experience depend on third parties under their own terms: Substack for subscriptions, Apple’s App Store terms for the iOS app, and the AI assistant platforms (such as OpenAI or Anthropic) through which you may connect to CS Atlas. We are not responsible for third-party services.
Intellectual property
The Service and its content are owned by Creative Strategies and its licensors and are protected by intellectual-property laws. No rights are granted except as stated in these terms. If you send us feedback, we may use it without restriction or obligation.
Suspension and termination
You may stop using the Service at any time and cancel your subscription through Substack. We may suspend or terminate access that breaches these terms, threatens the security or integrity of the Service, or is required by law. Sections that by their nature should survive — including license restrictions, disclaimers, limitation of liability, and governing law — survive termination.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.
Limitation of liability
To the fullest extent permitted by law, Creative Strategies will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities, arising from or related to the Service. Our total liability for all claims relating to the Service is limited to the amount you paid for your subscription in the twelve months before the event giving rise to the claim.
Indemnification
You will indemnify and hold Creative Strategies harmless from claims and expenses (including reasonable attorneys’ fees) arising from your breach of these terms or misuse of the Service.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Santa Clara County, California, and you consent to their jurisdiction.
Changes to these terms
We may update these terms as the Service evolves. We will post the new version at this URL and update the date above, and we will notify active subscribers of material changes. Continued use of the Service after changes take effect constitutes acceptance.
